ST. PAUL, Minn. (KMSP) -

Brian Fitch Sr., 39, the suspect wanted in connection with the fatal shooting of Mendota Heights Police Officer Scott Patrick, is listed in serious condition at Regions Hospital after a shootout with police on Wednesday night in St. Paul.

Patrick was shot during a routine traffic stop in West St. Paul on Wednesday afternoon, and Fitch was taken into custody on Wednesday night after a shootout ensued. St. Paul Police Department Sgt. Paul Paulos confirmed Fitch fired first, firing several rounds at officers. Police returned fire, striking Fitch several times. Sgt. Paulos also confirmed a handgun was recovered from the vehicle where Fitch was arrested, but did not confirm if the gun was connected to Patrick's shooting death.

Charges are expected to be filed in Dakota County on Friday. Police are not seeking any additional suspects. Fitch was already a wanted man on a Department of Corrections warrant before that fatal stop. He was also released from prison in February on supervised release for a burglary conviction.

St. Paul police also confirmed Maplewood woman, Kelly Lee Hardy, 36, was a passenger in Fitch's car and was struck by gunfire during Fitch's arrest. She is currently in fair condition with non-life threatening injuries at Regions. She is not under arrest at this time.

Brian George Fitch Sr. has a huge rap sheet that includes assault, escape, burglary, theft, assault and terroristic threats. He also had a warrant out of Washington County for failing to pay child support.
