Convicted killer on the run after cutting tether

Carla Harris is angry, frustrated and fearful for her safety now that Dwayne Ballinger is on the run. Ballinger was convicted in a double murder for the shooting deaths of Harris' son, Mario, and Darius Jones on July 4, 2006.

He was sentenced to life in prison, but was released on a tether back in June after Judge Arthur Tarnow found his lawyer was ineffective and granted him a new trial.

"He confessed, he was convicted, he was sentenced," she says. "You let him go, and now he's cut the damn tether off and he's fleeing. You don't know where he is. What does he have to lose?"

Harris sat in court and came face-to-face with Ballinger many times. He's accused of threatening the victim's family members and witnesses within hours after his release.

Attorney General Bill Schuette filed an emergency appeal in June with the Supreme Court to get Ballinger put back in prison.

"This guy never should have been on the loose. There are dangerous criminals, murderers on the street. They ought not to be released from prison in the first place," says Schuette.

The U.S. Court of Appeals recently reversed Judge Tarnow's decision and Ballinger was supposed to go back to prison. He disappeared from the tether at exactly 3:03 p.m. Thursday afternoon. Judge Tarnow's clerk says he has no comment on what has happened.

"Who do you turn to? You can't turn to the law because they're setting them free," Harris says. "So now that you set him free and now you want to get him and lock him back up, you can't find him. Did you really think he was going to sit around and let you take him back to jail after you released him? No. That's common sense."

Harris says she doesn't want sympathy, she just wants justice and the freedom of knowing Ballinger is back behind bars where he belongs. Authorities are currently looking for him.
